Lorem Ipsum has been the industry's standard dummy text ever since the 1500s, when an unknown printer took a galley of type and scrambled it to make a type specimen book. It has survived not only five centuries, but also the leap into electronic typesetting, remaining essentially unchanged. It was popularised in the 1960s with the release of Letraset sheets containing Lorem Ipsum passages, and more recently with desktop publishing software like Aldus PageMaker including versions of Lorem Ipsum.

It is the Policy of the Whispering Oaks Estates Homeowners Association, Inc. (“HOA”), to follow the below described processes for violations of the Covenant “No Overnight Street Parking”:

“Overnight Street Parking” is considered a significant safety issue: Whispering Oaks Streets are narrow with low levels of evening light.

“Overnight Street Parking” is defined as any vehicle parking on Whispering Oaks Streets during the period of after sundown and before sunrise.

Any member of the ACC, Board Member or Officer is authorized to issue a yellow card describing the No Overnight Street Parking Covenant Violation. After issuing at least 2 such warning notices and/or other oral conversations the ACC Member, Officer or Board Member can request the ACC to issue a seven (7) calendar day Notice informing the property owner that any future violations after the seven (7) day notice period will result in a request to the HOA Board to take further action.

This ACC seven (7) days’ notice letter provides the property owner and/or their tenant or guest the opportunity to arrange overnight parking other than on the street. If such overnight parking on the street occurs, after the seven (7) calendar days following receipt of the letter, The ACC will request the Board of Directors to take further action.

Prior to the HOA Board Meeting where the HOA Board will deliberate on what action to take on an unresolved Complaint; the HOA Member violating the Covenants will be encouraged to attend that HOA Board Meeting to state their appeal, in person, to the full HOA Board.

The HOA Board will review the ACC’s request to consider further action on the unresolved Complaint.

It is the Policy of the Whispering Oaks Estates Home Owners Association, Inc. (“HOA”), to follow the below described processes.

The Whispering Oaks Home Owners Association, (“HOA”) Board of Directors or the Architectural Control Committee (“ACC”) will accept anonymous or un- signed complaint forms and act on them provided they are found to be current, accurate and verified violations of the Covenants.

Upon receipt of an anonymous or un-signed Complaint Form a Member of the HOA Board or a Member of the ACC will visit the property in question. If the Board or ACC Member believes that the property which is the subject of the complaint is in violation of the Covenants, the HOA Board or ACC Member will note that finding on the Complaint Form.

Subsequently, this unsigned or anonymous Complaint Form will be put into the normal ACC Complaint Procedure.

If the HOA Board or ACC Member doesn’t find the Complaint to be a violation of the Covenants they will note such on the Complaint Form and place the Complaint Form in the appropriate address file of the Board & ACC.

It is the Policy of the Whispering Oaks Estates Home Owners Association, Inc. (“HOA”), to follow the below described processes in the event Whispering Oaks incurs storm damage or other events creating fallen trees and debris on Whispering Oaks streets:

Tree’s and/or Debris on HOA Property: The HOA Board selects contractor, schedules and accepts/pays cost.

Tree’s and/or Debris on HOA Home Owner Property: Property Owner selects contractor, schedules and accepts/pays cost.

Tree’s and/or debris on HOA Home Owner Property that falls on streets: HOA Board selects contractor, schedules and shares pro-rata cost with Property Owner. If there is a conflict with the Home Owner the HOA Board will select the contractor, schedules, & accepts /pays cost for that portion of the Tree/Debris that lies on the street.

It is the Policy of the Whispering Oaks Estates Home Owners Association, Inc. (“HOA”), to follow the below described processes for the HOA Budget and Reserve Accounts:

• Each year, the Treasurer of the HOA prepares an Annual Budget that sets out the Annual Operating Expenses for the next year. The Budget also reflects the estimated final revenues and expenses for the current and the estimated final surplus or deficit for the current year.
• The HOA By-Laws and Covenants do not provide for reserve accounts for capital expenditures and deferred maintenance that may result in special assessments. Therefore, in-accordance with Florida Regulations, the following statement is made in each annual budget and annual financial report for the HOA.

“THE BUDGET OF THE HOA DOES NOT PROVIDE FOR RESERVE ACCOUNTS FOR CAPITAL EXPENDITURES AND DEFERRED MAINTENANCE THAT MAY RESULT IN SPECIAL ASSEESSMENTS. OWNERS MAY PROVIDE FOR RESERVE ACCOUNTS PURSUANT TO SECTION 720.303(6), FLORIDA STATUES, UPON OBTAINING THE APPROVAL OF A MAJORITY OF THE TOTAL VOTING INTEREST OF THE ASSOCIATIONBY VOTE OF THE MEMBERS AT A MEETING OR BY WRITTEN CONSENT.”

It is the Policy of the Whispering Oaks Estates Home Owners Association, Inc. (“HOA”), to follow the below described Complaint Procedure:

All complaints will be processed by the ACC in-accordance with the procedure provided for in the Covenants:

• The Complaint shall be in writing by a HOA Member or Renter and sent to the ACC Chairperson.
• The ACC Chairperson will forward the complaint to the appropriate ACC Representative.
• If the Complaint is not signed by a HOA Member or Renter, the ACC Representative will make a good faith effort to investigate the Complaint and if they determine the Complaint is valid; they will sign the Complaint and continue with this Covenant Violation Procedure.
• The ACC Representative will promptly investigate the Complaint and attempt to secure a resolution.
• If resolution is not achieved the Complaint will be referred to the ACC Chairperson for further action. The Chairperson will canvass the Committee to confirm any recommended action.
• If Complaint remains unresolved, the ACC Chairperson will issue a Notice of Concern (1st notice) with a 10-day curative period (This notice of concern can be prepared and mailed regular mail and/or hand delivery by any Member of the ACC.)
• If resolution is still not achieved the Complaint will be referred to the ACC Chairperson for further action. The Chairperson will canvass the Committee to confirm any recommended action.
• If Complaint remains unresolved; the ACC Chairperson will issue a notice of violation (2nd Notice) with a 10-day curative period. (This notice of violation can be prepared and mailed regular mail and/or hand delivery by any Member of the ACC.)
• After issuing the 2nd ACC letter – Notice of Violation, without resolution, the ACC Chairperson will canvass the Committee to confirm any recommended action and then will advise the HOA Board, in writing, of the Issue; requesting the Board give consideration for further action:
• Description of the issue and commentary regarding the unsuccessful resolution process.
• Copy of any Complaints.
• Copy of the Letters issued.
• Copy of any other documents pertinent to the Complaint.

This notice to the Board will also be sent, Regular & Certified Mail, to the owner of the property that is in violation of the Covenant’s. This Notice will encourage them to take the opportunity to address the full Board regarding the Covenant violation at the Board’s meeting wherein the Board is scheduled to hear the ACC’s appeal. (This Notice can be prepared and mailed Certified mail and regular mail by any Member of the ACC.)

At any step in the process; the HOA Member violating the Covenants will be provided the opportunity to appeal the issue to the full HOA Board.

Prior to the HOA Board Meeting where the HOA Board will deliberate on what action to take on an unresolved Complaint; the HOA Member violating the Covenants will be encouraged to attend that HOA Board Meeting to state their appeal, in person, to the full HOA Board.

The HOA Board will review the ACC’s request to consider further action on the unresolved Complaint.

• If the majority of the HOA Board concurs with the ACC that further action should be taken, unless there are special circumstance to be considered, the HOA Board will:
• Issue a letter/notice summarizing the Covenant violation and the unsuccessful efforts by the ACC to resolve the matter.
• The letter/Notice will advise the HOA Member what action is expected to provide resolution to the Covenant violation.
• The Notice will provide a 7-day curative period.
• Failure to comply, will result in the HOA Board hiring a contractor to correct the Covenant violation or refer the matter to mediation.

Note: any notice of concern, notice of violation or Notice described above; can be prepared and mailed regular mail or hand delivery and by Certified mail, if appropriate, by the Secretary to the Board by written direction of the ACC Chairperson.

This Policy summarizes for the HOA Treasurer the Procedure the HOA Treasurer is to follow on any Property Owner where their account has become delinquent.

• A delinquent account is defined as:
• The Account arrears exceed $200.00.
• The Arrears Account is delinquent for ninety (90) or more calendar days.
• HOA Treasurer will send a “Notice of Late Assessment” to the address(s) of record on the Property Owners Account. This Notice provides the Property Owner with thirty (30) calendar days to bring their Account up to date. “Addresses of record” include the property address and the Property Owner’s mailing address, if different.
• If the Property Owner does not use this opportunity to bring their account up to date by the end of the Thirty (30) day period: The delinquent Property Owner’s Account will be turned over to the HOA’s Attorney of record for further action.

NOTE: If the HOA Treasurer believes the Property Owner may have extenuating circumstances for the late payment of their delinquent
